Terms of Service

1 Agreement to Terms

By booking, scheduling, or otherwise engaging R360° Real Estate Photography & Video ("R360°," "we," "us," or "our"), operated by Alpha Resolution Inc., you ("Client") agree to be bound by these Terms of Service ("Terms"). These Terms constitute a legally binding agreement between you and R360°. If you do not agree to these Terms, do not book or use our services.

These Terms apply to all services booked through our website (r360state.com), our online order forms, by phone, email, or any other method of engagement.

2 Services & Scope

R360° provides professional real estate photography and media services including, but not limited to:

  • HDR Real Estate Photography
  • 4K Cinematic Video Reels
  • Drone / Aerial Photography & Video
  • Virtual Staging, Virtual Twilight & Sky Replacement
  • 2D and 3D Floor Plans
  • Short-Term Rental (Airbnb) Photography
  • Photo editing add-ons (Object Clean-Up, De-Clutter, etc.)

Scope Limitation: Services are limited strictly to what is described in the selected package or add-ons at the time of booking. Verbal requests made on-site that fall outside the booked scope are not guaranteed and may incur additional charges.

Square Footage: Pricing is based on the square footage provided by the Client at the time of booking. If the actual square footage at the time of the shoot materially exceeds what was reported (by more than 10%), R360° reserves the right to invoice for the applicable upgrade at the standard rate.

R360° does not provide interior design, staging, cleaning, or any physical preparation services. The property must be ready before our team arrives.

3 Scheduling & Property Access

Confirmed Appointments: Appointments are confirmed upon receipt of booking through our order form and, where required, payment. Appointment times are approximate — our team will make every reasonable effort to arrive within the scheduled window.

Access Requirements: The Client is responsible for ensuring that R360° has full, unobstructed access to the property at the scheduled time. This includes:

  • Providing accurate entry instructions (lockbox codes, gate codes, contact person)
  • Ensuring all interior and exterior spaces included in the booking are accessible
  • Confirming access with tenants, HOA, or building management as needed

Lockout / No Access: If our photographer arrives and cannot access the property within 15 minutes of the scheduled start time due to reasons within the Client's control (no access code provided, locked gate, no-show, etc.), the appointment will be treated as a same-day cancellation and the full session fee will be charged. No refund will be issued.

People on Property: For best results, the property should be vacant during the shoot. R360° is not responsible for delays caused by occupants, tenants, contractors, or other parties present during the shoot.

Pets: All pets must be secured and removed from areas being photographed prior to our arrival.

4 Cancellation & Rescheduling

Client Cancellation:

  • 48+ hours before appointment: Full refund or free rescheduling, no penalty.
  • 24–48 hours before appointment: 50% of the session fee is non-refundable. Rescheduling is permitted once at no additional charge.
  • Less than 24 hours before appointment: 100% of the session fee is charged. No refund will be issued.
  • Same-day cancellation or no-show: Full session fee charged. No refund.
Cancellations must be submitted in writing via email to info@alphares.net. Phone or text cancellations are not accepted as official notice.

R360° Cancellation: R360° reserves the right to cancel or reschedule an appointment due to photographer illness, equipment failure, unsafe weather conditions, or other circumstances beyond our control. In such cases, the Client will receive a full refund or a complimentary reschedule at the Client's preference. R360° is not liable for any damages, losses, or costs incurred by the Client as a result of such cancellation.

Weather Policy: Outdoor and drone services may be rescheduled at R360°'s sole discretion due to inclement weather (rain, high winds, heavy overcast, smoke/haze). Interior photography will proceed as scheduled regardless of weather unless the property itself is inaccessible. If weather prevents drone services on the day of the shoot, indoor photography will proceed and the drone portion will be rescheduled at no additional charge.

5 Property Preparation

The Client is solely responsible for ensuring the property is properly staged, cleaned, and prepared before our team arrives. R360° will not wait for cleaning, staging, or any other preparation tasks to be completed on-site.

Required before our arrival:

  • All rooms cleaned, decluttered, and staged as desired
  • All exterior areas tidy — garbage bins stored, vehicles removed from driveway, garden hoses stowed
  • All lights turned on (interior and exterior) with working bulbs
  • Toilet lids closed
  • Personal items, valuables, and sensitive documents removed or hidden from view
  • Pool/spa water cleaned and clear (if applicable)

No Re-Shoots for Preparation Issues: R360° will not issue refunds or provide complimentary re-shoots for issues caused by inadequate property preparation (e.g., clutter left in frame, lights not on, staging not complete). Any re-shoot requested due to preparation issues will be charged at the standard rate.

R360° photographers will not move, rearrange, or remove personal items, furniture, or décor from the property. Any staging adjustments during the shoot are at the photographer's sole discretion and are not guaranteed.

6 Payment Terms

Payment Due: Payment is due at the time of booking unless otherwise agreed in writing. R360° reserves the right to require full payment before scheduling or delivering any services.

Accepted Methods: We accept major credit cards, debit cards, and other payment methods as displayed at checkout through our order form.

Delivery Hold: Final deliverables (photos, video, floor plans) will not be delivered until payment is received and confirmed in full. R360° reserves the right to withhold delivery of all media until outstanding balances are settled.

Late Payment: Any invoice not paid within 7 days of the delivery date is subject to a late fee of 1.5% per month (18% annually) on the outstanding balance.

Refund Policy: Refunds are issued only in accordance with the cancellation policy in Section 4. Once media files have been delivered, no refunds will be issued. Dissatisfaction with creative output (composition, style, weather conditions, etc.) does not qualify for a refund.

Chargebacks: If a Client initiates an unauthorized chargeback, R360° reserves the right to pursue recovery of all fees owed, including chargeback fees, legal fees, and collection costs.

7 Deliverables & Turnaround Time

Turnaround times are estimates and begin from the date of the completed shoot, not the booking date. Standard delivery windows by service type:

  • HDR Photography: 1–2 business days
  • Photography + Video Bundle: 2–4 business days
  • Video Only: 2–4 business days
  • Floor Plans: 2–3 business days
  • Virtual Staging / Editing Add-ons: 2–3 business days after photo delivery

Rush delivery may be available for an additional fee. Contact us prior to booking to confirm availability.

Delivery Format: Photos are delivered as high-resolution JPEGs via an online download gallery. Videos are delivered as MP4 files via download link. Files are available for download for 90 days from the delivery date. R360° is not responsible for maintaining archives beyond this period.

Turnaround times may be extended during peak seasons, holidays, or due to circumstances beyond our control. R360° will communicate any delays proactively.

8 Revisions & Re-Shoots

Photo Revisions: Each package includes one round of minor editing revisions (e.g., brightness/exposure adjustments, minor color corrections). Revision requests must be submitted within 5 business days of delivery.

What Does Not Qualify as a Revision:

  • Requests to re-shoot due to property condition or staging at the time of the shoot
  • Requests to change composition, angles, or number of photos beyond those captured
  • Stylistic preferences that differ from R360°'s standard editing style
  • Changes to virtually staged furnishings after the staging has been completed

Re-Shoots: Re-shoots are not included in any package. If a re-shoot is needed for reasons within R360°'s control (technical equipment failure, missed agreed-upon rooms), R360° will schedule a complimentary re-shoot of the affected areas only. Re-shoot requests for any other reason will be quoted at the applicable standard rate.

9 License & Usage Rights

Upon receipt of full payment, R360° grants the Client a non-exclusive, non-transferable license to use the delivered media for the following purposes:

  • MLS (Multiple Listing Service) listings
  • Real estate marketing materials (flyers, brochures, postcards)
  • Client's social media channels related to the listed property
  • Client's personal website or real estate brokerage website

Prohibited Uses: The license does not permit:

  • Transfer or sublicense of the media to any third party (including other agents, buyers, or developers) without R360°'s written consent
  • Use of the media for commercial advertising campaigns unrelated to the subject property
  • Resale or redistribution of the media files
  • Alteration or modification of the media files in ways that misrepresent the property
Usage rights are tied to the specific property. Once the property is sold or the listing is removed, continued use of the media for other properties or listings is not permitted without a new license agreement.

10 Copyright & Portfolio Use

R360° retains full copyright ownership of all photographs, videos, and media created during every session. The license granted in Section 9 does not constitute a transfer of copyright.

Portfolio Use: R360° retains the right to display any media created for Clients in its portfolio, website, social media channels, and marketing materials unless the Client provides written notice prior to the shoot requesting confidentiality. Confidential listing requests must be submitted in writing to info@alphares.net before the appointment date.

Credit: When reasonably possible, R360° appreciates photo credit ("Photo: R360°") but does not require it for standard MLS or marketing use.

11 Drone & Aerial Services

All drone operations are conducted in compliance with FAA Part 107 regulations. R360° pilots are FAA-certified. By booking drone services, the Client acknowledges and agrees to the following:

  • FAA Restrictions: Drone services cannot be performed in FAA-restricted or controlled airspace, near airports, military installations, or other restricted zones. If the property falls within a restricted zone, R360° will notify the Client and a refund or credit for the drone portion will be issued.
  • Weather Limitations: Drone flights may be cancelled or postponed due to wind speeds exceeding safe thresholds, rain, low visibility, or other unsafe conditions at the sole discretion of the R360° pilot.
  • Local Ordinances: Some municipalities, HOAs, or private properties may restrict drone flights. It is the Client's responsibility to verify that drone photography is permitted at the property location before booking.
  • No Trespassing: R360° drones will not be flown over neighboring properties without explicit permission where required.
  • Liability: R360° carries liability insurance for drone operations. However, R360° is not responsible for flight cancellations due to regulatory, weather, or access restrictions outside our control.

12 Limitation of Liability

To the maximum extent permitted by applicable law:

  • R360°'s total liability to the Client for any claim arising out of or related to services provided shall not exceed the total amount paid by the Client for the specific session giving rise to the claim.
  • R360° shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, lost listings, lost sales opportunities, or damages resulting from delays in delivery.
  • R360° is not liable for property damage, theft, or loss during shoots unless caused by gross negligence or willful misconduct on the part of our team.
  • R360° is not responsible for technical issues with third-party delivery platforms, download link expiration, or the Client's failure to download files within the 90-day window.
R360° makes no warranties — express or implied — that the media will meet the Client's subjective expectations, produce a specific sales outcome, or perform in any particular way in the market.

13 Indemnification

Client agrees to indemnify, defend, and hold harmless R360°, Alpha Resolution Inc., and their respective officers, employees, contractors, and agents from and against any and all claims, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:

  • Client's breach of these Terms
  • Client's use of the delivered media in ways not permitted by these Terms
  • Any claims by property owners, tenants, HOAs, or third parties related to the shoot that arise from Client's actions or representations
  • Client's provision of inaccurate property information (access codes, square footage, restrictions)

14 Dispute Resolution

Good Faith Negotiation: In the event of any dispute, both parties agree to first attempt resolution through good faith communication. Disputes should be submitted in writing to info@alphares.net with a clear description of the issue.

Binding Arbitration: If a dispute cannot be resolved within 30 days of written notice, it shall be submitted to binding arbitration administered by JAMS or a mutually agreed arbitration service, conducted in San Diego County, California. The arbitrator's decision shall be final and binding.

Small Claims Exception: Either party may bring claims in small claims court in San Diego County, California, if the claim qualifies.

Governing Law: These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Venue for any legal proceedings shall be San Diego County, California.

No Class Actions: The Client agrees to resolve disputes with R360° on an individual basis only and waives the right to participate in class action lawsuits or class-wide arbitration.

15 Privacy & Data

R360° collects basic contact and property information necessary to fulfill your booking. This data is used solely for scheduling, delivering services, and communicating with you about your order. We do not sell or share your personal data with third parties except as required to deliver services (e.g., payment processors, scheduling platforms).

By booking our services, you consent to receiving transactional communications related to your order (confirmation, delivery, invoicing). You may opt out of marketing communications at any time.

16 Amendments & Entire Agreement

R360° reserves the right to update or modify these Terms at any time. Updated Terms will be posted at r360state.com/terms-of-service/ with a revised effective date. Your continued use of our services after any such update constitutes your acceptance of the revised Terms.

These Terms, together with any order confirmation or written service agreement, constitute the entire agreement between you and R360° regarding our services and supersede any prior representations, understandings, or agreements.

If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
